Stolen Vehicle & Firearm Possession – Charges Dropped

The client was observed trying to get a truck unstuck at a property full of snow. Police were called and arrested the person for being in possession of a stolen vehicle as well as having in his possession a firearm. The person was incarcerated while waiting for his trial.

Defence Action

Ms. Verdurmen had the client’s detention reviewed in British Columbia Supreme Court and he was released so that he could be outside of jail waiting for his trial.

Before the trial, Ms. Verdurmen made an application to the court outlining a breach of the client’s Canadian Charter right to be free against an unreasonable search. She also made an application outlining a breach of a charter right related to the lack of documentation related to the investigation her client received.

Decision

The charges were dropped after the applications were submitted.
